Trump Modifies Section 338 Tariffs on Canadian Products, Removing Certain Plywood and Paper Products

On Friday, October 23, President Trump signed a proclamation further modifying tariffs on certain Canadian products under Section 338 of the Tariff Act of 1930. The changes follow tariffs initially announced on July 20 and modified on September 8.

The proclamation amends Proclamation 11048 by removing certain products, including plywood sheets, some paper products, machinery, refrigeration equipment, and packing crates and boxes, from the scope of Section 338 tariffs. These products are being replaced by certain valves, carpets, waste products, and other goods.

The Section 338 tariffs apply to all covered products regardless of whether they qualify for preferential treatment under the US-Mexico-Canada Agreement (USMCA). They also apply in addition to tariffs imposed under Section 232 of the Trade Expansion Act of 1962.

The product additions and removals are scheduled to take effect on October 30. The proclamation is available here, and a White House fact sheet is available here.
