Canadian Entities Request USMCA Panel Review of US Antidumping Decision for 2023
On Thursday, the US Department of Commerce (DOC) published a notice in the Federal Register stating that two requests for panel review under the US–Mexico–Canada Agreement (USMCA) have been filed in connection with the US antidumping duty administrative review of certain softwood lumber products from Canada.
The filings, submitted August 28, challenge the final results of the DOC’s 2023 review of Canadian lumber imports, which were published July 29.
The two requests were made by various companies, industry associations, provincial governments, and the federal government.
Under USMCA, a binational panel will be formed to review the challenged determination. The process is limited to alleged errors of fact or law and jurisdictional challenges identified in the complaints.
